Archived from groups: uk>rec>boats>motor (more info?)

If you bought a brand new MotorYacht with a CE-B License do you heave had
some certificates or what ever in the UK.

I have, I think, a more complicated case.
Our Kent 31 Cruiser is made by Cory Yachts International Ltd.
Bridge Wharf, Ramsgate Road
Sandwich
Kent, CT13 9LY
United Kingdom

and delivered as Casco to a Dutch Warf.
Who is responsible for the final CE-B License. Cory Yachts or the Dutch
Warf.

Thanks for all information in advance.
Gerard

Yes.

The law throughout the EU is that new boats must have (1) a CE plate
permanently affixed, showing details of the builder, the category of
certification, safe loadings (persons and baggage) etc.; (2) a CE
certificate and declaration of conformity giving the above information
and much more besides and (3) a handbook giving operating instructions,
layout and wiring diagrams, etc.

It depends on the stage of completion of the hull (casco) when delivered
to Holland. If it was a bare hull and incapable of certification then
whoever completed the boat (the Dutch yard) is responsible for issue of
the certificate.

If it was a more or less seaworthy boat when delivered and just needed
fitting out, Cory Yachts, as the first people to import or put the boat
on sale in the EU, are responsible for issuing the certificate, but the
Dutch yard, as traders, are responsible for passing it on to you with
the completed boat.

Some manufacturers who supply bare hulls or part completed boats have an
arrangement whereby they will supervise fitting-out or carry out
periodic inspections and issue a certificate on satisfactory completion.
I've no idea whether Cory Yachts have such an arrangement or not,
though.

In England it would be a criminal offence for a yard to sell a new boat
without the necessary certificate, whether they were the manufacturers
or just dealers, but I've no idea of the law in Holland. Although the CE
regulations are the same throughout the EU, enforcement and penalties
vary from country to country.
